1. TERMS AND CONDITIONS OF USE.

Welcome to the Palm Beach County Online Employment Application (the "Site"). This page "Notice") states the terms and conditions of the Site. Please review this Notice carefully. By accessing, browsing, or using the Site ("Use"), all users and viewers ("You," "you," "User," or "user,") acknowledge acceptance of the terms and conditions listed in this Notice. If you do not accept the terms and conditions listed in this Notice, please do not use the Site. Palm Beach County reserves the right to update this Notice from time to time in its sole discretion. You should review this Notice periodically for updates and changes. REGARDLESS OF THE METHOD OF SUBMITTAL OF ANY APPLICATION MATERIALS, THESE TERMS AND CONDITIONS WILL APPLY.

2. PURPOSE OF SITE.

Palm Beach County provides this Site only as a service to all users pursuing career opportunities with Palm Beach County. The Site provides users with access to an array of career opportunities and detailed information about each position. There is no cost to users to access this Site or use our services.

3. ELIGIBILITY.

The Site and any related services are available to you, provided that you can form legally binding agreements under applicable law.

4. LICENSE.

Palm Beach County grants you a limited, non-exclusive, non-transferable, non-assignable, revocable license to view and temporarily download a copy of the materials displayed on the Site solely for your personal and non-commercial use for yourself. All materials displayed or made available on the Site, including, but not limited to, graphics, documents, text, images, sound, video, audio, artwork, software, and HTML code (collectively, the Material are exclusive property of Palm Beach County. The Materials are protected by U.S. and international copyright laws and any other applicable intellectual property rules, regulations, and laws. Except as expressly permitted herein, you shall not (i) (i) use, copy, modify, display, delete, distribute, download, store, reproduce, transmit, publish, sell, re-sell, adapt, reverse engineer, or create derivative works of the Material, or (ii) use the Material on other web sites or any media, e.g., networking environment, without Palm Beach County's prior written consent.
All trademarks, service marks, and logos (the "Marks") displayed on the Site are exclusive property of Palm Beach County. You shall not use the Marks in any manner without Palm Beach County's prior written consent.

5. USER SUBMISSIONS.

The Site provides a forum for you to submit employment documents. By submitting your information to the Site, you agree that you will provide true, accurate, current and complete information about yourself. Further, you agree that you have read the Candidate's Code of Ethics. If you provide any information that is untrue, inaccurate, not current or incomplete, or if Palm Beach County, for any reason or for no reason, determines whether such information is untrue, inaccurate, not current or incomplete, Palm Beach County reserves the right to investigate the information and may unilaterally suspend any future interaction with you as a User, in its sole discretion.

Application materials submitted to Palm Beach County are considered to be job-specific and are deemed part of an optional employment submittal process. In conjunction with the submission of your application materials, you grant permission to Palm Beach County to use, copy, modify, display, distribute, reproduce and transmit your application materials to the specific potential departments as deemed advisable by Palm Beach County. You acknowledge that Palm Beach County will screen and score your assessment materials. However, while Palm Beach County does screen and score your assessment materials, Palm Beach County cannot make any representation regarding the reliability, accuracy, completeness, validity, or truthfulness of any application materials you may submit. Palm Beach County reserves the right, in its sole discretion, to delete, remove, refuse to display, or block any application materials that Palm Beach County considers to be unacceptable.

You acknowledge and agree that Palm Beach County may retain copies of your application materials and disclose said materials to parties with legally enforceable authority over Palm Beach County if Palm Beach County believes that it is necessary to:

• (i) protect the rights of Palm Beach County and/or the candidate;
• (ii) comply with any court order or administrative order;
• (iii) comply with any applicable law, codes or ordinances; and/or
• (iv) comply with any public records request.

In accordance with Florida Public Records law, Chapter 119, F.S., any information that you submit as part of the job search and selection process is subject to disclosure to third parties and may be inspected, examined and copied by any person desiring to do so unless specifically exempted by law.

6. GENERAL PROHIBITION.

In connection with your Use, you agree NOT to:

• Violate any local, state, and federal rules, regulations and statutes, including, but not limited to, U.S. export laws and regulations, anti-discrimination, or equal opportunity employment laws;
• Infringe any intellectual property and privacy rights, including, but not limited to, patent, copyright, trademark, or trade secrets, of any third party;
• Upload, post, transmit, or store any material that:
  • is unlawful, offensive, defamatory, fraudulent, deceptive, misleading, harmful, threatening, harassing, obscene, pornographic, or objectionable;
  • breaches any of your contractual or confidentiality obligations;
  • disrupts or interferes with the normal operations of the Site, such as posting or transmitting viruses, continuous posting of repetitive materials, or posting abnormally large load;
  • is not permitted by Palm Beach County, including, but not limited to, any unauthorized advertising materials, unsolicited promotional materials, "junk mail", "spam mail", "chain letters", pyramid schemes, franchises, distributorship, club membership, sales arrangement, or otherwise unacceptable materials; or

• Violate another's privacy rights or personal rights by abusing the materials, including, but not limited to, harassing or "stalking" another person, sending unsolicited e-mails, and collecting another's personal information;

• Breach or attempt to breach any security measures of the Site;
• Use any device, process, or mechanism to monitor, retrieve, search, or access, the Site or any material without Palm Beach County's prior written consent;
• Copy, modify, reproduce, delete, distribute, download, store, transmit, sell, re-sell, publish, reverse engineer, or create derivative works of any materials, except for materials that have been submitted and owned by you;
• Impersonate any person or entity;
• Forge any header information in any electronic posting or mail; or
• Misrepresent yourself, your affiliation with any third party, or your entity.

7. SPECIFIC USAGE AND RESPONSIBILITIES.

In addition to the general responsibilities listed in Section 6, you agree to:

• Use the Site only for lawful purposes in searching for employment opportunities and career information;
• Post materials for which you have all the necessary rights or licenses;
• Use your own judgment, caution, and common sense in managing and applying for job opportunities and information offered by or obtained from the Site.

8. EMPLOYMENT.

You understand and agree that Palm Beach County does not warrant that you will receive any employment or job offers through the Site. You shall use your own judgment, caution, and common sense in evaluating any prospective job opportunities listed on the Site.

If selected as a candidate for a specific job for which you have applied, your employment application provides a release that allows Palm Beach County to conduct the necessary reference checks, background checks, civil and criminal litigation checks, national and warrant check, and education, certification and professional license verifications to supplement your candidate profile. This process will be conducted in accordance with applicable federal and state laws.

9. PRIVACY.

Palm Beach County may store information submitted by you. See Section 5 for more details regarding your submission. In addition to the potential disclosure of user-identifiable information as stated in Section 5, Palm Beach County may disclose aggregate information to potential or retained clients, such as general demographics and statistical compilations. Because you are seeking employment in the public sector, a public pronouncement or disclosure may be necessary as governed by applicable state law or an employer’s internal guidelines. By accepting this Notice, you acknowledge that any information that you submit as part of the job search and selection process is subject to disclosure to third parties unless specifically exempted by law.
Further, you agree you have read Palm Beach County's Privacy Policy.

10. INDEMNIFICATION.

You agree to indemnify, defend, and hold Palm Beach County and its subsidiaries, affiliates, officers, directors, agents, employees, and insurers from any claims or demands, including, but not limited to, attorneys' fees and legal fees and costs, resulting from or arising out of your Use of the Site, your application materials, or your violation of any terms and conditions of this Notice.

11. DISCLAIMER.

You acknowledge and accept that: (a) you assume all risks related to or resulting from your usage, viewing, or access of the site. The site is provided on an "as is" and an "as available" basis; (b) Palm Beach County expressly disclaims all warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or warranties arising from course of performance, course of dealing or usage; (c) Palm Beach County expressly disclaims all warranties that (i) the site and its materials will be error-free or virus-free, (ii) the site will be uninterrupted and secure, (iii) the site will be uninterrupted and available at all times, (iv) the site will meet your requirements. Additionally you acknowledge and attest that the application materials submitted are reliable, accurate, complete, valid, and truthful.

12. LIABILITY AND LIMITATIONS OF LIABILITY.

You agree to assume all risks associated with, arising out of, or resulting from your use of the site or any application materials, including, but not limited to, the risks of financial loss, physical harm, property damages, and dealing with other users of the site, including strangers, minors, foreign nationals, and persons acting under false pretense. You further agree to release Palm Beach County, subsidiaries, affiliates, officers, agents, and employees and insurers, harmless from all claims, demands, damages (direct, indirect, and consequential) of any kind or nature, known or unknown, associated with, arising out of, or resulting from your usage of the site, your application materials, and/or any transactions related to or resulting from your use of the site. You further understand and agree that in no event shall Palm Beach County, subsidiaries, affiliates, officers, agents, employees, suppliers and insurers be liable for any direct, indirect, consequential, incidental, special damages, or damages for loss of profits, goodwill, revenue, data, or use, incurred by you, whether in an action in contract, tort, or breach or failure of warranty, even if Palm Beach County has been advised of the possibility of such damages.

13. TERMINATION.

Palm Beach County has the right, in its sole discretion, to terminate any services of the Site and remove any materials or information from the Site. Palm Beach County may also terminate your access to any part or all of the services provided by Palm Beach County on the Site at any time, with or without cause or notice, for any reason. Palm Beach County shall not be responsible for maintaining or returning your application materials.

14. GENERAL.

You agree that there is no employment, partnership, agency, or joint venture relationship between you and Palm Beach County arising out of or resulting from your Use of the Site. This Notice constitutes the entire agreement between you and Palm Beach County governing your use of the Site and is additional to any binding agreement between you and Palm Beach County. Palm Beach County does not warrant that this Site will be lawful outside the United States. If you view, access, submit, or download materials to and from the Site outside the United States, you will be solely responsible for all your actions and assume all risks. You may not use or export any materials or make any copy or adaptation in violation of any application laws, rules, or regulations, including, but not limited to, U.S. export laws and regulations. The failure or delay by either party to enforce the terms of this Notice shall not be deemed as a waiver of such term. Sections 5, 6, 7, 9, 11, 12, 13, and 14 shall survive any termination of this Notice for any reasons.

Palm Beach County expects honesty and professionalism in all of our dealings with you as a candidate. By submitting your application materials you agree to:

• Not embellish or overstate the facts on any application materials
• List all employment history using the application profile and if additional space is required, attaching information that identifies total employment history
• Include all dates (month/year) for each employer including hours worked per week
• Accurately recap the level of responsibility and level of authority for each position
• Act in good faith throughout the recruitment and selection process

A candidate may be removed from the recruitment process in question and/or future recruitments if a candidate:

• Has made false or misleading statements of material fact on the application profile or other required documents
• Has used or attempted to use, any unfair method to obtain an advantage in an examination or appointment
• Does not possess one or more of the requirements as specified in the public announcement
• Receives or gives assistance resulting in an unfair advantage designed to aid an applicant in obtaining a job will be disqualified from the recruitment process and may be barred from future examinations
• Or employee receives such assistance or provides such assistance to an applicant they may be disciplined up to and including termination
• Directly or indirectly obtained confidential information about the content of an examination, or has taken part in compiling, administering, or scoring an examination
• Fails to submit a complete and accurate application within the prescribed time limits
• Has been convicted of a felony that is related to the employment sought
• Has verbally or physically threatened staff
• Has been previously employed by the County, and is currently not eligible for re-hire by the County

The Palm Beach County Board of County Commissioners is committed to protecting online users' privacy. We believe that protection of personal privacy on the Internet is our responsibility, to assure citizen confidence, increase participation in online activities, and support effective delivery of services. We intend to give you as much control as possible over your personal information. We collect some information that is used for analysis and statistical purposes that help us manage the Palm Beach County Human Resources web site.

1. Information that you provide us when using our interactive forms and functions .This information may include such things as name, address, telephone number, and other personal and business data, depending on the particular service you use. We collect only that data necessary to provide the service that you are requesting.
2. Control of personal information. At any time, while accessing our site, any user, while online, may decline participation in any activity that asks for information (i.e. survey, e-mail or e-commerce). Your choice not to participate will in no way affect your ability to use any other feature on our site. In online applications that ask for personal information, you also are provided the option of canceling or "clearing all fields" of information and terminating the application.
3. Use of cookies. Palm Beach County uses cookies to store a 'tag' (identical for each user) on your hard drive to enable automatic logon from your own computer. Palm Beach County also adds a unique cookie tag for each computer accessing the site. These unique tags are not linked to individual user names, only to the computer that is used to access our site. The names and email addresses of registered users are recorded in a database, which is used solely for the purpose of ensuring easy logon by returning guests. If you have not enabled cookies in your browser, these features will not work properly.
4. Disclosure to third parties. As a governmental agency, we are governed by public records laws. Any information that we receive through use of our site is subject to the same provisions as information provided on paper.
